Studio Neko-Neko Commission Policy
This policy is the standard by which the artist, Nicole “AnimeCat” Holland, hereby referred to as the Artist, handles the studio commissions. By agreeing to a commission you, hereby referred to as the Client, acknowledge that you have read over and accepted these terms and are hereby under contract.
1. Idea submissions and requesting commissions: a. Client is to contact Artist with commission idea. If a certain look/subject is desired, Client must be up front and provide all details possible. Artist is not responsible for missing any details not originally given in the commission request. b. Upon receipt of commission request and details, Artist will provide Client with a price quote. Quote is good for 60 days only, after which Client will need to request a new quote. c. If Client accepts quote, then he/she is considered under contract. He/she will be provided with a copy of this studio policy to review. Any questions/discussions regarding the policy must be made at this point, otherwise it is assumed that Client agrees to policy. d. Payment is due in full upon policy receipt. The Artist will make exceptions if the total price of the commission is greater than $300. If the price exceeds this, half of the payment is due up front and remainder upon completion of the commission.
2. Artwork Revisions a. Artist will provide Client with a work in progress update for each stage in the commission. This provides the Client with an opportunity to request revisions/alterations in the work. The Artist allows up to three revisions per stage, per Artist’s discretion. After three revisions, or if the Artist feels the extra effort is warranted, a fee of 10-25% of the final commission price will be added per revision, depending on complexity. b. Artwork revisions do not apply to images smaller than 5 x 7”. Projects that size or under will be completed and delivered to the Client as is. Client is to be aware of this upon acceptance of contract. c. Once the Client agrees to the revisions, the work moves on to the next stage. No revisions will be done on that stage of the work after that point.
3. Combat Pay and Cancellation of Commission a. If at any time Client exhibits behavior that Artist considers unreasonable, such as and not limited to: harassment, badgering, profane language, request for excessive revisions, changing of commission, etc; Artist reserves the right to charge the Client extra fees/ cancel the Client commission. b. Extra fees charged under such circumstances are considered “Combat Pay” and will not exceed 50% of original commission price. Combat Pay will only be requested in extreme circumstances. c. Artist reserves the right to cancel commissions at any stage. d. The Client also has the right to cancel the commission at any stage. e. Commissions cancelled will have the price paid refunded to the Client in part once the work has been started. Should the commission be cancelled in the pencil sketch stage, the Client will be refunded 75% of their fees. If the commission is cancelled past this stage, the Client will receive 25-50% of their fees depending on the amount of progress done on the work up until that point.
4. Deadlines a. It is up to the Client to inform the Artist if a certain deadline must be met. If no deadline is requested, Artist will place the Client’s commission at the end of the current work queue. Estimated time of completion varies with each work, so completion times may range from six weeks to several months. b. Once deadline is set and agreed upon by Artist and Client, it cannot be changed without incurring a surcharge. This fee will be 25% of original commission price. c. Delays in completion times do occur on occasion. Artist is to inform Client of delays in deadline as soon as possible. If delay should be more than 1 week from set deadline, Client is entitled to 10% of their commission price refunded. Client may also choose to cancel his/her commission. See section 3 for details.
5. Copyrights a. Unless otherwise stated, all copyrights for the finished work lie with the Artist. Client retains rights to his/her characters as intellectual property; Artist retains all other rights. b. Unless otherwise stated, Artist retains all reproduction/publication rights. Such rights can be purchased, but must be stated and agreed to in writing as part of the Client contract. c. Artist agrees not to resell Client’s work without Client’s written permission, with the sole exception of the work to be included in an image collection/portfolio. d. Exclusivity rights are not included with commission, Client must purchase separately. e. Artist reserves the right to republish/reprint/redistribute any Client’s work for display/advertisement/portfolio purposes. Such distribution shall not require Client’s permission. f. Client may not use work purchased from Artist for profit- such is violation of copyright and subject to all laws and consequences thereof- unless redistribution rights/royalties have been purchased and are part of the original contract agreement. g. In purchasing work from Artist, Client does have permission to display said work as long as credit is given and work remains unaltered. Client will be provided with a digital copy of work containing the studio watermark for this purpose.
6. Completion of Work and Delivery a. All digital works created for Client will be delivered to Client through e-mail or download. Client must provide Artist with a working e-mail address. b. All real media works created for Client will be delivered through registered USPS mail. Insurance and delivery confirmation is required. All shipping/handling fees are Client’s responsibility. c. Upon request, completed commissions can be picked up at a desired location if Artist will be in attendance. Artist will not make efforts to be at a given location unless previous plans have been discussed with Client. Please note- this option is not always available. d. Artist will inform Client upon completion of their commission and impending delivery.
